Nothing in these policies excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, including the consumer guarantees. Where anything below is inconsistent with those rights, those rights apply. Everything below operates subject to the Australian Consumer Law and Fair Trading Act 2012 (Vic), not instead of it.

1. Prices, price changes and pricing errors

All prices are in Australian dollars and include GST unless we say otherwise.

Our suppliers change their prices without notice to us, and a price shown on this website or quoted in store can be out of date before we know about it.

A price shown on this website is an invitation to treat, not an offer. Your order is an offer to buy at that price, and a contract is formed only when we accept your order. The automated email confirming we’ve received your order is not acceptance.

If the price has changed, or was listed in error, before we accept your order, we will contact you and you choose: go ahead at the corrected price, or cancel and receive a full refund of everything you have paid. We will not charge you the higher price without your agreement. Refunds are made to your original payment method within 5 business days of you telling us to cancel.

Once we have accepted your order, the price we accepted is the price you pay.

2. Machines left with us for service or repair

While your machine is with us you remain its owner and we hold it on your behalf.

Assessment fee. We charge $55 to assess your machine and work out what it needs. If you go ahead with the repair, or buy a new machine from us instead, the $55 comes off that price. If you decide to do nothing, the $55 is payable when you collect the machine. We tell you about the assessment fee before you leave the machine with us.

We contact you when the work is finished, or when you decline a quote. Please collect your machine promptly once we do.

Until you have paid for work we’ve carried out on your machine, we may keep the machine.

If your machine is not collected, we may eventually dispose of it — but only by following the process in Part 4.2 of the Australian Consumer Law and Fair Trading Act 2012 (Vic). What we can do depends on the value of the machine:

  • Under $200. After written notice to you and a further 28 days — or 60 days if we have made reasonable attempts and cannot reach you — we may sell, destroy or keep the machine.
  • $200 to $4,999. After written notice to you and to any other owner, and a further 28 days — or 90 days if we have made reasonable attempts and cannot reach you — we may sell the machine by public auction or private sale. We will not keep it or dismantle it for parts.
  • $5,000 and over. We may only dispose of the machine in accordance with an order of the Victorian Civil and Administrative Tribunal.

If we sell your machine, we deduct what you owe us and the actual costs of the sale. Anything left over is not ours: it is dealt with as unclaimed money under the Unclaimed Money Act 2008 (Vic) and remains claimable by you. If the sale does not cover what you owe, the balance remains payable.

Storage. Workshop space is limited, so if your machine is still with us 14 days after we notify you that it is ready, we charge storage of $10 per week or part week from that date. This reflects what the space costs us; it is not a penalty. Storage stops accruing when you collect the machine, and is included in what you owe if we later have to dispose of it.

3. Goods you have paid for but not collected

Goods you have paid for are yours, and if they are left with us they are uncollected goods under the same law and the same process in clause 2 applies.

We will contact you when your goods are ready and again before we take any further step. If they remain uncollected after the statutory period, we may treat the sale as cancelled, return the goods to stock and refund what you paid, less any costs we have actually incurred on your order such as freight or non-returnable special-order charges. We will not keep both your goods and your money.

4. Goods you have collected but not paid for

Payment is due on collection unless we have agreed account terms with you in writing.

Where an account is overdue, interest accrues on the outstanding amount at the penalty interest rate fixed from time to time under section 2 of the Penalty Interest Rates Act 1983 (Vic), calculated daily from the due date until payment, and you are responsible for the costs we actually incur in recovering the debt. We charge what recovery genuinely costs us — there is no fixed penalty.

5. Goods neither paid for nor collected

Both clauses apply together. We follow the disposal process in clause 2 for the goods, and the debt remains payable. Any proceeds of sale are applied first to what you owe us and the costs of sale, with any surplus treated as unclaimed money as described in clause 2, and any shortfall remaining recoverable from you.

6. Our repair warranty

Repairs we carry out are warranted for 3 months from the date you collect the machine, covering the parts and materials we supply and the workmanship of the repair.

What we will do. If a part we supplied and fitted, or the workmanship of our repair, fails within those 3 months under normal use, we will repair or replace it at no cost to you.

What you need to do to claim. Contact us on 0411 508 608 or admin@geelongpressurewashers.com.au, or bring the machine to Geelong Pressure Washers, Factory 8, 9B Gravel Pits Road, South Geelong VIC 3220. Claims may be sent to that address.

Proof of purchase. Warranty claims need your original receipt or invoice, so please keep it somewhere safe. Separately from this warranty, a claim under the Australian Consumer Law can be supported by any reasonable proof of purchase, such as a bank or credit card statement.

Who pays what. You are responsible for getting the machine to our workshop. We bear the cost of the warranty repair itself, including parts and labour.

What this warranty does not cover. Faults unrelated to the work we carried out. Wear items, being parts that wear out in normal use: seals and O-rings, valves, nozzles, lances and trigger guns, hoses and fittings, filters and strainers, brushes and pads, belts, spark plugs, pump and engine oil, and batteries. Damage caused by misuse, neglect, freezing, running the machine dry, running it without the correct oil, or using incorrect fuel or chemicals. Normal servicing and consumables.

The benefits given to you by this warranty are in addition to other rights and remedies you have under a law in relation to the goods or services to which this warranty relates.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
